Я уже писала, что выходила замуж в Грузии. И я, и мой супруг, и даже свидетели являемся гражданами Российской Федерации. И вот перед нами встал вопрос о том, как оформить развод, находясь в России. В Грузию лететь в COVID и при отсутствии прямых самолетов совсем не хотелось.

По российским законам не важно, где был зарегистрирован брак между гражданами России, разводиться можно на территории РФ в российском органе государственной власти (в суде, если есть претензии и/или общие несовершеннолетние дети, в ЗАГСе — если можно обойтись без привлечения суда).

У нас с моим супругом не было детей, имущественных споров и других факторов, запрещающих нам расторгнуть брак полюбовно. Разве что нам нужно было обратиться в ЗАГС по прописке одного из супругов. Мы оба прописаны в Петербурге, но в разных районах, из удобства выбрали мою прописку, поэтому решили развестись в ЗАГСе Центрального района на Суворовском проспекте. Дело было в январе — феврале 2021 года.

Подача заявления

Тут обломаю сразу, через Госуслуги не получится, мы пробовали. Чтобы заполнить заявление на расторжение брака на Госуслугах, надо в специальном поле заполнить все данные из свидетельства о заключении брака (они не проходят валидацию, так как отличаются от российских) и указать орган, это свидетельство выдавший. И тут вы столкнетесь с тем, что ни одного органа иностранной юрисдикции в выпадающем списке нет, что логично. Внести эти данные вручную тоже нельзя.

Поэтому, к сожалению, надо записаться в ЗАГС и подать заявление лично и оффлайн. Для подачи заявления нужны оба супруга с паспортами РФ (загранпаспорта не нужны, несмотря на то, что брак был заключен по ним) и оригинал свидетельства о заключении брака с апостилем и переводом на русский язык, если язык оригинала свидетельства не русский (у нас грузинский).

Так как я уже писала, апостиль на свидетельстве и перевод был сделан еще в Доме Юстиции в Тбилисси, перед подтверждением брака на территории России, то самым сложным в нашем разводе оказалось согласовать время обоих пока еще супругов и прийти в ЗАГС. Но мы справились.

Заявление подается стандартное, как и на Госуслугах, просто сотрудник ЗАГСа проверяет данные из иностранного свидетельства, написанные нами, лично. Потом назначается дата развода, не раньше чем через месяц после подачи заявления. Важное в этой дате то, что хотя бы один из супругов в эту дату должен прийти в ЗАГС лично и расписаться в книге около актовой записи. Так же на руки он получит свой оригинал свидетельства о расторжении брака.

День расторжения брака

Мы решили прийти ввдоем, так как нам обоим было удобно. Сотрудник еще раз проверил свидетельство о браке, наши паспорта, внес актовую запись о разводе, выдал 2 оригинала свидетельства о расторжении брака российского образца (по одному на каждого супруга) и мы поставили свои подписи в актовой книге. В наши внутренние российские паспорта поставили штампы о расторжении брака. Паспорта сразу же отдали.

Дальше встал вопрос, что делать с свидетельством о браке. По идее его изымают и передают в архив для хранения. Где-то пишут, что ставят погашающие штампы с датой развода и номером актовой записи. Но на иностранном свидетельстве никто никаких пометок не делал и нам его просто отдали назад. Сейчас оно хранится у меня, чуть-чуть погрызанное котиком на случай, если пригодится его оригинал. Хотя я слышала, что и российские свидетельства не всегда забирают.

Выводы

Мой опыт показывает, что что подтверждать брак, заключенный заграницей, что потом разводиться на территории РФ достаточно просто и понятно. Если вы сразу в другой стране озаботитесь апостилем, а по приезде в Россию переведете документ у официального переводчика на русский язык, то ваше свидетельство о браке не будет сильно отличаться от российского. Сроков дополнительных это точно не добавит, разве что нельзя будет что-то оформлять через Госуслуги, но это мелочи.

Так что если есть сокровенная мечта жениться в другой стране, например на мальдивских пляжах, или в Лас-Вегасе, чтобы вас расписывал Элвис, то бояться бумажной волокиты в России точно не стоит.
